Terms of Use

1 Definitions and Interpretation

In these Terms of Use ("Terms"), the following definitions apply unless the context requires otherwise:

• "Platform" means the website IsYourTraderReal.com, including all pages, subdomains, APIs, tools, databases, and any related services operated by the Operator.
• "Operator" means Signal Core s.r.o., a company incorporated under the laws of the Czech Republic, with its registered office at Rybná 716/24, Staré Město, 110 00 Praha 1, Czech Republic, Company ID (IČO): 24460354.
• "User" means any person or entity who accesses, browses, uses, or interacts with the Platform in any manner, whether registered or unregistered.
• "Content" means all information, text, data, reports, assessments, ratings, verdicts, images, graphics, user submissions, and other materials published on or through the Platform.
• "Subject" means any individual, trader, mentor, signal provider, company, group, or entity that is the subject of an investigation, report, assessment, or user submission on the Platform.
• "User Content" means any information, data, evidence, testimonials, reviews, comments, or other materials submitted by Users through the Platform.
• "Investigation Report" means any assessment, analysis, rating, verdict, or editorial content produced by the Operator's team regarding a Subject.

2 Acceptance of Terms

By accessing or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety, together with our Privacy Policy. If you do not agree to these Terms, you must immediately cease all use of the Platform.

The Operator reserves the right to modify, amend, or update these Terms at any time without prior notice. Continued use of the Platform following any such modifications constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.

3 Nature and Purpose of the Platform

3.1 Public Interest and Consumer Protection

The Platform operates as a public interest information service and consumer protection resource. Its purpose is to provide transparency in the financial trading education and services industry by publishing factual information, editorial opinions, assessments, and community-sourced reports regarding individuals and entities operating in this sector.

3.2 Journalistic and Editorial Activity

The Operator engages in journalistic, editorial, and investigative activities within the meaning of applicable press, media, and freedom-of-expression laws, including but not limited to:

• Article 17 of the Charter of Fundamental Rights and Freedoms of the Czech Republic (Listina základních práv a svobod);
• Article 10 of the European Convention on Human Rights (freedom of expression);
• Article 11 of the Charter of Fundamental Rights of the European Union;
• Relevant provisions of Act No. 89/2012 Coll., the Civil Code of the Czech Republic (Občanský zákoník), particularly provisions governing the protection of personality (§ 81 et seq.) balanced against freedom of expression and the right to information.

Investigation Reports published on the Platform constitute editorial opinion and commentary based on available evidence, not statements of absolute fact. They represent the Operator's good-faith assessment based on information available at the time of publication.

3.3 Not Financial Advice

Nothing on this Platform constitutes, or should be construed as, financial advice, investment advice, trading advice, legal advice, or any form of professional recommendation. The Platform does not recommend or endorse any financial product, service, trading strategy, or provider. Users must exercise their own independent judgment and seek qualified professional advice before making any financial decisions.

4 Investigation Reports and Assessments

4.1 Methodology

Investigation Reports are prepared through a combination of:

• Publicly available information and open-source intelligence;
• Voluntary disclosure by the Subject (including, where provided, investor-password access to trading accounts on a read-only basis);
• User-submitted evidence and testimonials;
• Third-party data sources, public records, and regulatory databases;
• The Operator's proprietary analysis methodologies and editorial judgment.

4.2 Verdicts and Ratings

Verdicts, scores, ratings, labels (including but not limited to "Verified," "Scam," "Under Review," "Pending," and "Inconclusive"), and any similar designations published on the Platform represent the Operator's subjective editorial opinion and assessment based on the evidence and information available at the time of assessment. They are not definitive legal determinations, court judgments, or regulatory findings.

The designation "Scam" or similar negative labels reflects the Operator's editorial opinion that, based on available evidence, the Subject's activities exhibit characteristics commonly associated with fraudulent, deceptive, or materially misleading conduct in the financial services industry. Such designation does not constitute a legal finding of fraud and does not imply that any criminal or civil proceedings have been initiated or concluded against the Subject.

4.3 Right of Response

Any Subject of an Investigation Report has the right to contact the Operator to:

• Provide additional evidence or clarification;
• Request correction of factual inaccuracies;
• Submit a formal response that may be published alongside the Investigation Report.

The Operator commits to reviewing such submissions in good faith and updating reports where warranted by new evidence. However, the Operator retains sole editorial discretion over the content, conclusions, and publication of all Investigation Reports.

4.4 No Guarantee of Accuracy

While the Operator endeavors to ensure the accuracy and completeness of all Content, the Operator makes no warranty, representation, or guarantee, express or implied, regarding the accuracy, completeness, reliability, timeliness, or fitness for any particular purpose of any Content published on the Platform. Information may become outdated, circumstances may change, and errors may occur despite reasonable diligence.

4.5 Verification Process and Track Record Requests

As a standard part of the investigation and verification process, the Operator may contact the Subject and request the provision of verifiable trading performance history ("track record"), typically by means of read-only investor-password access to trading accounts, verified broker statements, or equivalent independently auditable documentation.

If the Subject does not respond to, refuses, or fails to cooperate with such a verification request, or provides data that cannot be independently verified or that the Operator reasonably suspects to be falsified, manipulated, or incomplete, the Operator reserves the right to:

• State this fact in the Investigation Report as a factual observation (e.g., "The Subject did not provide access to trading records when requested" or "The Subject declined to cooperate with verification");
• Take the Subject's non-cooperation into account as one factor in its overall editorial assessment;
• Publish the Investigation Report based on other available evidence without the Subject's input.

The publication of the fact that a Subject has declined to provide verifiable trading data constitutes a factual statement, not an evaluative judgment, and does not in itself represent an unlawful interference with the Subject's reputation or personality rights. The Operator's editorial assessments and verdicts are expressed as subjective evaluative judgments based on available evidence (e.g., "based on our assessment," "in the Operator's opinion," "the available evidence indicates"), not as absolute statements of criminal or legal guilt.

5 Performance Verification and GIPS Standard

5.1 GIPS-Compliant Assessment Methodology

Where the Operator conducts performance verification of trading accounts, the assessment methodology is based on and adheres to the Global Investment Performance Standards (GIPS®), as published by the CFA Institute. GIPS is the globally recognized standard for the ethical presentation of investment performance and provides a framework for fair representation, full disclosure, and comparability of investment results.

5.2 Scope of GIPS Application

The Operator applies GIPS-aligned principles in the following areas:

• Input data integrity — performance data is sourced from verified trading accounts using read-only investor-password access, broker statements, or other independently verifiable sources;
• Calculation methodology — returns are calculated using time-weighted or money-weighted methods as appropriate, in accordance with GIPS standards;
• Composite construction — where multiple accounts or strategies are assessed, results are aggregated following GIPS composite construction guidelines;
• Disclosure — all material facts relevant to the interpretation of performance results are disclosed in the Investigation Report, including account size, time period, leverage, drawdown, and trading conditions;
• Fair representation — the Operator does not cherry-pick favorable or unfavorable periods; performance is evaluated over the full available track record.

5.3 Independent Verification

The Operator's performance verification process constitutes an independent third-party assessment. The Operator is not a GIPS-verified firm but applies GIPS principles as the methodological framework for fair and transparent performance evaluation. Subjects are informed of the methodology used and may provide additional context or clarification during the verification process.

5.4 Limitations

Performance verification is limited to the data made available to the Operator. The Operator cannot verify the existence or performance of accounts to which access has not been granted. Past performance data, even when independently verified, does not guarantee future results. The Operator explicitly disclaims any representation that verified past performance is indicative of future trading outcomes.

6 Use of Images, Photographs, and Likeness

6.1 Legal Basis for Use of Images

The Platform may display photographs, images, screenshots, avatars, profile pictures, and other visual representations of Subjects ("Images") as part of Investigation Reports and trader profiles. The use of such Images is legally justified on the following grounds:

• Journalistic and editorial purpose — Images are used in connection with matters of public interest, namely the investigation and reporting on individuals and entities offering financial services, trading education, or investment advice to the public. This use falls within the scope of journalistic and editorial activity protected by Article 10 of the European Convention on Human Rights, Article 17 of the Charter of Fundamental Rights and Freedoms of the Czech Republic, and § 89 of Act No. 89/2012 Coll. (Czech Civil Code), which permits use of likeness without consent for purposes of press, science, art, or similar reporting activity;
• Public figures and public activity — Subjects who publicly offer financial services, trading signals, mentorship, or investment education through websites, social media, advertising, or other public channels are engaged in public commercial activity. Under § 88(2) of the Czech Civil Code and established case law of the European Court of Human Rights (ECHR), the use of images of persons engaged in public commercial activity for purposes of reporting, commentary, and consumer protection does not require the Subject's prior consent;
• Publicly available sources — Images used on the Platform are sourced exclusively from publicly available materials, including but not limited to: the Subject's own websites, public social media profiles (Instagram, Twitter/X, YouTube, TikTok, Facebook, LinkedIn), marketing materials, press releases, public appearances, conference photographs, publicly available trading platform profiles, and other materials that the Subject has voluntarily made available to the general public;
• Consumer protection and fraud prevention — the use of Images serves the legitimate purpose of enabling consumers to accurately identify individuals and entities that are the subject of investigations, thereby preventing confusion, mistaken identity, and facilitating informed decision-making by the public.

6.2 Proportionality and Fair Use

The Operator applies the following principles when using Images:

• Images are used solely for identification and editorial purposes directly related to the Platform's consumer protection mission;
• Images are not used in a manner intended to ridicule, humiliate, or cause gratuitous harm to the Subject beyond what is necessary for legitimate reporting;
• Images are not altered, manipulated, or presented in a misleading context;
• Images are displayed in a reasonable size and format appropriate for identification purposes;
• The Operator uses the minimum number of Images necessary to fulfill the identification purpose.

6.3 Image Removal Requests

Subjects may request the removal or replacement of specific Images by contacting the Operator at the address provided in Section 20. The Operator will consider such requests on a case-by-case basis, weighing the Subject's privacy interests against the public interest in maintaining accurate and complete Investigation Reports. The Operator may:

• Replace a specific image with an alternative publicly available image of the Subject;
• Remove the image if it is not essential for identification purposes and does not materially affect the integrity of the Investigation Report;
• Decline removal where the image serves a legitimate editorial or identification purpose that outweighs the Subject's privacy interest, particularly in cases where the Subject has been assessed as engaging in potentially fraudulent or deceptive conduct.

6.4 User-Submitted Images

Users who submit images as part of evidence submissions represent and warrant that they have the legal right to share such images and that the images are authentic and unaltered. The Operator is not liable for any intellectual property infringement, right of publicity violations, or other claims arising from User-submitted images, and Users agree to indemnify the Operator against any such claims.

6.5 Screenshots and Evidence

The Platform may display screenshots of publicly accessible websites, social media posts, trading platform interfaces, marketing materials, and other digital content as documentary evidence supporting Investigation Reports. Such use constitutes fair dealing for purposes of criticism, review, and reporting in the public interest under applicable copyright and intellectual property laws, including Directive 2001/29/EC (InfoSoc Directive), Article 5(3)(c) and (d), and § 31 of Act No. 121/2000 Coll. (Czech Copyright Act).

6.6 Copyright Notice and Takedown Procedure

In accordance with Regulation (EU) 2022/2065 (Digital Services Act — "DSA") and the principles of the U.S. Digital Millennium Copyright Act ("DMCA"), the Operator maintains a formal procedure for handling copyright infringement claims related to Images or other content displayed on the Platform.

If you are a copyright holder (or authorized to act on behalf of one) and believe that content on the Platform infringes your copyright, you may submit a written notification ("Copyright Takedown Notice") to the Operator at the contact details provided in Section 20, including:

• Identification of the copyrighted work(s) claimed to be infringed;
• Identification of the allegedly infringing content on the Platform, including the specific URL(s);
• Your full legal name, contact information, and proof of identity;
• A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
• A statement, under penalty of perjury (or equivalent declaration under applicable law), that the information in the notification is accurate and that you are authorized to act on behalf of the copyright owner;
• Your physical or electronic signature.

Upon receipt of a valid Copyright Takedown Notice, the Operator will:

• Acknowledge receipt within 5 business days;
• Evaluate whether the use of the content falls within the applicable exceptions and limitations to copyright (including fair dealing for criticism, review, and reporting under § 31 of the Czech Copyright Act, Article 5(3) of the InfoSoc Directive, and the journalistic exception);
• If the use does not qualify for an exception, remove or disable access to the infringing content within a reasonable timeframe;
• If the Operator determines the use is lawful under applicable exceptions, notify the complainant of its decision with reasons.

The Operator will not comply with takedown requests that are manifestly unfounded, frivolous, abusive, or that are submitted in bad faith for the purpose of suppressing legitimate editorial content, obstructing investigations, or circumventing the Platform's consumer protection mission. Submitting false or misleading Copyright Takedown Notices may expose the submitter to liability for damages under applicable law.

7 User Content and Submissions

7.1 User Responsibility

By submitting any User Content to the Platform, you represent and warrant that:

• All information you provide is truthful, accurate, and not misleading to the best of your knowledge;
• You have the legal right to share such information and that doing so does not violate any applicable law, regulation, contractual obligation, or third-party right;
• Your submission does not contain knowingly false, defamatory, malicious, or fraudulent statements;
• You are not submitting information for the purpose of harassment, personal vendetta, competitive sabotage, or any other improper purpose;
• You understand that false, knowingly inaccurate, or malicious submissions may expose you to civil and criminal liability under applicable law.

7.2 License Grant

By submitting User Content, you grant the Operator a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from such User Content for the purposes of operating, maintaining, and improving the Platform and fulfilling its public interest mission.

7.3 Moderation and Review

All User Content is subject to review and moderation by the Operator. The Operator reserves the right, at its sole discretion, to:

• Approve, reject, edit, redact, or remove any User Content;
• Publish User Content in anonymized or pseudonymized form to protect submitter identity;
• Use User Content as part of broader investigation and editorial processes;
• Disclose User Content and associated metadata to law enforcement authorities when required by law or court order.

7.4 No Confidentiality and Metadata Responsibility

Unless explicitly stated otherwise, User Content submitted to the Platform is not treated as confidential. While the Operator takes reasonable measures to protect submitter identity (including displaying only first names and partially masking IP addresses in public-facing content), the Operator cannot guarantee absolute confidentiality and may be compelled to disclose information pursuant to valid legal process.

Metadata warning: Users who submit evidence files (including but not limited to screenshots, PDF documents, email exports, images, and other digital files) are solely responsible for removing any embedded metadata, EXIF data, author information, file properties, or other identifying information from such files before submission. The Platform does not perform forensic sanitization of uploaded files and cannot guarantee that metadata or other embedded information will be stripped. Users acknowledge that failure to remove identifying metadata may enable the Subject or third parties to identify the submitter, and the Operator bears no liability for any consequences arising from the submitter's failure to sanitize uploaded files.

7.5 Distinction Between Editorial Content and User Submissions

The Platform publishes two distinct categories of content, which are subject to different legal regimes:

• Editorial Content (Investigation Reports, verdicts, ratings, assessments, and editorial commentary) — produced by the Operator's editorial team following internal review and verification processes. The Operator assumes full editorial responsibility for this content and defends it under the journalistic and editorial privileges set out in Section 3.2;
• User-Submitted Content (reports, evidence, testimonials, and comments submitted by Users) — constitutes third-party content that is subject to moderation and editorial review before incorporation into any Investigation Report. Prior to editorial review and approval, the Platform does not adopt or endorse the content of user submissions.

User submissions that have been verified, assessed, and incorporated into an Investigation Report become part of the Operator's Editorial Content. Unverified or pending user submissions that may be displayed on the Platform (e.g., user comments, pending reports) are clearly identified as user-generated content, and the Operator does not assume editorial responsibility for their accuracy until and unless they have undergone the Operator's review process.

8 Intellectual Property

8.1 Operator's Intellectual Property

All Content, design, graphics, logos, trademarks, trade names, software, databases, methodologies, and the overall look and feel of the Platform are the exclusive property of the Operator or its licensors and are protected by Czech, European Union, and international intellectual property laws. No part of the Platform may be reproduced, distributed, modified, framed, deep-linked, or otherwise exploited without the prior written consent of the Operator.

8.2 Permitted Use

Users may share links to specific pages on the Platform and may quote limited excerpts for the purposes of commentary, criticism, news reporting, or academic research, provided that proper attribution to IsYourTraderReal.com is given and the use constitutes fair dealing under applicable law.

9 Limitation of Liability

9.1 General Limitation

To the maximum extent permitted by applicable law, the Operator, its directors, officers, employees, agents, affiliates, and licensors shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising out of or in connection with:

• Your use of, or inability to use, the Platform;
• Any Content published on the Platform, including Investigation Reports, verdicts, ratings, or User Content;
• Any decisions made, actions taken, or transactions entered into based on Content available on the Platform;
• Any errors, omissions, inaccuracies, or outdated information in any Content;
• Any loss of profits, revenue, data, reputation, goodwill, or business opportunity, whether direct or indirect;
• Any unauthorized access to, or alteration of, your data or submissions;
• Any third-party conduct, content, products, or services mentioned on or linked from the Platform.

9.2 Maximum Liability

In any event, and to the maximum extent permitted by applicable mandatory law (including § 2898 of Act No. 89/2012 Coll., Czech Civil Code), the Operator's total aggregate liability to any User for any and all claims arising out of or related to these Terms or the use of the Platform shall not exceed EUR 100 (one hundred euros). This limitation does not apply to liability that cannot be lawfully excluded or limited under mandatory provisions of applicable law.

9.3 Assumption of Risk

You expressly acknowledge and agree that your use of the Platform is at your sole risk. The Platform and all Content are provided on an "AS IS" and "AS AVAILABLE" basis, without any warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or completeness.

10 Indemnification

10.1 General Indemnification

You agree to indemnify, defend, and hold harmless the Operator, its directors, officers, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:

• Your use of the Platform or any Content;
• Your submission of User Content, including any claims of defamation, invasion of privacy, or intellectual property infringement arising from your submissions;
• Your violation of these Terms or any applicable law or regulation;
• Your infringement of any third-party rights;
• Any dispute between you and any Subject or other third party.

10.2 Liability for False, Fabricated, or Malicious Submissions

If a User intentionally submits false, fabricated, misleading, or maliciously motivated information, evidence, or reports to the Platform — including but not limited to submissions made for the purpose of competitive sabotage, personal vendetta, harassment, market manipulation, or any other improper purpose — and such submissions result in the Operator being subject to legal claims, demands, lawsuits, regulatory proceedings, or any other form of legal liability, the submitting User agrees to:

• Fully indemnify the Operator for all legal costs, attorneys' fees, court costs, damages, settlements, penalties, fines, and any other expenses incurred by the Operator as a direct or indirect consequence of such false or malicious submission;
• Reimburse the Operator for any damages, compensation, or settlements the Operator is required to pay to the affected Subject or any third party as a result of the fabricated submission;
• Cooperate fully with the Operator in the defense of any claims arising from the User's submission, including providing testimony, documentation, and other assistance as reasonably required.

The Operator reserves the right to pursue independent legal action against any User who knowingly submits false or fabricated information, including claims for damages under § 2910 et seq. of the Czech Civil Code (liability for fault-based harm) and, where applicable, reporting the matter to law enforcement authorities for potential criminal prosecution under § 345 (false accusation) or § 184 (defamation) of Act No. 40/2009 Coll. (Czech Criminal Code).

11 Privacy and Data Protection

11.1 GDPR Compliance

The Operator processes personal data in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation — "GDPR") and Act No. 110/2019 Coll. on the Processing of Personal Data of the Czech Republic. The Operator's processing of personal data related to Subjects is carried out primarily on the following legal bases:

• Legitimate interest (Article 6(1)(f) GDPR) — the Operator's legitimate interest in providing a public interest consumer protection and transparency service, balanced against the data subject's rights;
• Journalistic exemption (Article 85 GDPR, § 17 and § 18a of Act No. 110/2019 Coll.) — processing necessary for journalistic, academic, artistic, or literary expression;
• Public interest — processing in the public interest of consumer protection in the financial services sector.

11.2 Data Collected

When Users interact with the Platform, the Operator may collect:

• IP addresses (partially masked in public display);
• Country of origin (derived from IP geolocation);
• Names or pseudonyms provided in submissions (displayed publicly as first name only);
• Email addresses (used solely for communication regarding submissions, never published);
• Submission content and attached files;
• Browser and device information for security and anti-abuse purposes.

11.3 Rights of Subjects

Subjects of Investigation Reports may exercise their rights under the GDPR by contacting the Operator. However, the Operator may refuse or limit the exercise of certain rights (including the right to erasure, the right to object, and the right to restriction of processing) where:

• Processing is necessary for exercising the right of freedom of expression and information (Article 17(3)(a) GDPR);
• Processing is carried out for journalistic purposes under the exemptions provided by Article 85 GDPR and implementing national legislation;
• Processing serves compelling legitimate interests that override the data subject's interests, rights, and freedoms;
• Compliance would undermine the Platform's public interest mission of consumer protection.

Each request is assessed individually, taking into account the balance between the data subject's rights and the public interest in maintaining transparency.

12 Prohibited Conduct

Users shall not:

• Submit false, fabricated, misleading, or knowingly inaccurate information;
• Use the Platform for harassment, stalking, intimidation, or personal vendettas;
• Attempt to manipulate, game, or abuse the investigation and reporting system;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Use automated systems, bots, scrapers, or crawlers to access or extract data from the Platform without prior written authorization;
• Attempt to gain unauthorized access to the Platform's systems, servers, databases, or networks;
• Interfere with or disrupt the integrity, performance, or availability of the Platform;
• Use the Platform to distribute malware, spam, or unsolicited communications;
• Reproduce, mirror, frame, or create derivative works of the Platform without authorization;
• Use the Platform in any manner that violates applicable local, national, or international law.

13 Third-Party Content and Links

The Platform may contain links to third-party websites, services, or resources (including but not limited to TrustPilot profiles, social media accounts, and external trading platforms). Such links are provided for informational purposes only and do not imply endorsement, sponsorship, or affiliation. The Operator has no control over, and assumes no responsibility for, the content, privacy policies, practices, availability, or accuracy of any third-party services.

14 Takedown and Dispute Procedure

14.1 Requesting Corrections or Removal

Any Subject or affected party who believes that Content on the Platform is factually inaccurate, outdated, or unlawful may submit a written request to the Operator at the contact details provided below. Such request must include:

• Full identification of the requesting party and proof of identity;
• Specific identification of the Content at issue (including URL);
• Detailed explanation of the alleged inaccuracy or unlawfulness;
• Supporting evidence or documentation.

14.2 Review Process

The Operator will review takedown requests within a reasonable timeframe (typically 30 business days) and may:

• Correct factual inaccuracies where supported by evidence;
• Update the report with new information;
• Publish the Subject's response alongside the existing report;
• Decline the request with reasons, where the Operator determines the Content is accurate, constitutes legitimate editorial opinion, or serves the public interest.

The Operator's decision regarding Content published on the Platform is final from an editorial perspective, without prejudice to the requesting party's right to seek judicial remedies.

15 Governing Law and Jurisdiction

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of laws principles.

15.2 Jurisdiction

Any disputes arising out of or in connection with these Terms or the use of the Platform shall be submitted to the exclusive jurisdiction of the competent courts of the Czech Republic, specifically the Municipal Court in Prague (Městský soud v Praze), unless mandatory provisions of the law of the User's country of habitual residence provide otherwise for consumer disputes.

15.3 Alternative Dispute Resolution

In accordance with Regulation (EU) No. 524/2013, consumers residing in the EU may submit disputes to the Online Dispute Resolution (ODR) platform at https://ec.europa.eu/consumers/odr. The Operator's email for ADR purposes is provided below.

16 Disclaimer of Warranties
