1 Overview
The appeal mechanism is a formal process separate from the Trader Response Framework. While the response framework allows traders to submit initial evidence and request a review, the appeal mechanism is designed for cases where a trader has already gone through the response process and remains dissatisfied with the outcome, or where significant new evidence has emerged.
Appeals are reviewed by a senior panel independent from the original investigation team to ensure impartiality.
2 Eligibility Criteria
To file a formal appeal, you must meet at least one of the following criteria:
- Prior response submitted: You have already submitted a response through the Trader Response Framework and received a final decision that you wish to challenge.
- New material evidence: You have obtained significant new evidence that was not available at the time of the original investigation or response review, and that could materially change the findings.
- Procedural error: You believe there was a procedural error in the investigation or response review process that affected the fairness of the outcome.
- Factual inaccuracy: You can demonstrate specific factual errors in the published report that are verifiable and material to the verdict.
Appeals that do not meet any of the above criteria, or that merely restate arguments already considered during the response process without new evidence, may be declined without full review.
3 Appeal Submission
You may submit your appeal using the form below or by emailing appeals@isyourtraderreal.com directly. Your submission must include:
- Your full legal name and contact information
- The URL or slug of your IsYourTraderReal trader profile
- A clear statement of the grounds for appeal (referencing the eligibility criteria above)
- A detailed explanation of why you believe the verdict should be changed
- All supporting evidence as attachments (documents, account access, certificates, etc.)
4 Review Timeline
The appeal review process follows a structured timeline to ensure thoroughness and fairness:
- Acknowledgement (within 5 business days): You will receive confirmation that your appeal has been received and is being processed.
- Eligibility check (within 10 business days): Our team will assess whether your appeal meets the eligibility criteria. If it does not, you will be informed with an explanation.
- Full review (up to 30 business days): The appeal will be reviewed by a senior panel of at least two investigators who were not involved in the original report. They may contact you for additional information.
- Decision notification (within 5 business days of decision): You will be notified of the outcome in writing, with detailed reasoning for the decision.
- Profile update (within 3 business days of decision): If the verdict changes, your profile will be updated promptly.
5 Possible Outcomes
An appeal can result in one of three outcomes:
Upheld
The original verdict is maintained. The appeal panel found no grounds to change the findings based on the evidence presented. The detailed reasoning will be provided in writing.
Partial Revision
Some findings are updated but the overall verdict category remains or is adjusted. Specific sections of the report may be modified, added, or removed based on new evidence.
Overturned
The original verdict is reversed. The trader's profile is updated to reflect the new findings. This occurs when evidence conclusively demonstrates the original verdict was incorrect.
The decision of the appeal panel is final within our internal process. If you remain dissatisfied, you may pursue external resolution through the Dispute Resolution Process.
6 Important Notes
- Each trader profile is entitled to one appeal per 12-month period unless significant new evidence emerges.
- Your existing profile and verdict will remain visible during the appeal review process.
- Filing an appeal does not guarantee a change in verdict — it guarantees a fair, independent review.
- False or misleading information submitted as part of an appeal may result in the appeal being dismissed and noted on your profile.
- Appeals are processed in the order they are received. We do not offer expedited appeal processing.
