4 Required Information in a Takedown Notice

For your takedown notice to be effective, it must contain all six elements listed in Section 3 above. Incomplete notices may not be acted upon. We will acknowledge receipt of valid notices within 5 business days and will take appropriate action, which may include removing or disabling access to the allegedly infringing material within 10 business days.

If your notice is incomplete, we will make a reasonable attempt to contact you to request the missing information before taking further action.

5 Counter-Notification Procedure

If you believe that material you posted on IsYourTraderReal.com was removed or access to it was disabled by mistake or misidentification, you may file a counter-notification with us. Your counter-notification must be in writing and include:

We will then restore the material within 10 to 14 business days after receiving the counter-notification, unless we receive notice that the original complainant has filed a court action seeking a restraining order.

6 Fair Use Policy

IsYourTraderReal acknowledges the principle of fair use (or fair dealing in applicable jurisdictions). We recognise that limited use of copyrighted material without permission may be permissible for purposes such as:

Our verification reports may include screenshots, quotes, or other materials from traders' public profiles, advertisements, and communications. We believe such use constitutes fair use/fair dealing because it serves the public interest in consumer protection, is transformative in nature (adding analysis and commentary), and does not serve as a market substitute for the original work.

When evaluating DMCA takedown requests, we will consider whether the allegedly infringing material qualifies as fair use before removing it.

7 User-Submitted Content Licensing

By submitting content to IsYourTraderReal.com — including but not limited to evidence, screenshots, documents, text, reports, comments, or any other materials — you agree to the following terms:

If you wish to have your submitted content removed, you may contact us at legal@isyourtraderreal.com. We will review removal requests on a case-by-case basis, taking into account the public interest in maintaining comprehensive investigation records.

8 Repeat Infringers

In accordance with the DMCA and other applicable laws, we have adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. We may also limit access to the platform or terminate accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
